These terms of use apply to contracts between the company websystems d. David Gstrein (hereinafter also referred to as "operator" or "websystems") and users regarding the cloud software "verleihtool.com" (hereinafter referred to as "Verleihtool", "Tool", or "Software").
The user is enabled to use Verleihtool over the Internet as so-called "Software as a Service". The operator provides the tool on its own servers or on servers of a data center in the EU for access. The software is made available for use via these servers, and data generated, collected, used, and stored during the use of the software is stored to the agreed extent and kept ready for designated remote access. Access to the tool and the stored data is possible at any time outside of maintenance windows unless the operator must carry out urgent support measures or other urgent actions to maintain usability.
No provision of the software in source code form takes place.
A simple, non-transferable right of use of the tool is granted for the duration of the contract.
The operator is not obliged to provide the user with documentation of the tool/user manual. The operator provides hints on the basic functionalities in the tool itself as well as on verleihtool.com and enables the user to access relevant information.
The tool is made available to the user for use from the router output of the data center operated by websystems or its service provider. The establishment and maintenance of the data connection between the user's end device and the transition point operated by websystems are the user's responsibility.
After the contract ends, it is no longer possible for the user to view the stored data in the tool.
Websystems is entitled to change the design, structure, and functionality of the tool. Websystems will inform the user about significant changes.
To rectify errors/defects of the tool or to achieve/maintain the contractual quality of the tool, websystems reserves the right to choose the type of defect rectification.
The operator is entitled to deny access to the tool and the stored data once a month for a maximum of 2 hours (maintenance window) in order to make changes to the tool or perform other maintenance work. Websystems will strive to keep restrictions for the user as minimal as possible, including performing work at night.
The user can set texts and images in the tool.
The user is responsible for ensuring that the content set by him or by third parties with his consent complies with the applicable law, in particular, does not violate the rights of third parties.
If it is reported to the operator by third parties that there is illegal content (text, image, video, etc.) in the profile, he is entitled to temporarily block this content wholly or partly. The operator will inform the user about the accusation of the third party, give him the opportunity to comment, and forward this to the third party. If no clear resolution of the dispute is possible in this way, the blocking of the affected content remains.
The user is not entitled to repost the same or substantially similar content.
If the user's data, e.g., his email address, changes, the user is obligated to notify the operator of the new data, insofar as this is necessary for the proper fulfillment of the contract.
The operator will regularly create backup copies to ensure the proper operation of the tool, which also include the content set by the user and the data recorded in the tool by him. Furthermore, the operator is entitled to create copies for archiving purposes and to store them for 12 months. If legal regulations require longer archiving, archiving will be carried out according to these periods. After that, the data will be deleted or otherwise destroyed.
If the operator has a legitimate interest in a further partial backup/archiving of content, e.g., if a third party has asserted claims against the user or the operator in connection with this usage contract, the operator is entitled to maintain the partial backup/archiving until the legal resolution of this dispute.
If the operator fraudulently conceals a defect of the tool and/or its other services to the user, he is obligated to compensate the user for the resulting damage.
Otherwise, the operator is only liable for intent and gross negligence.

The contract has a duration of 12 months and can be terminated by either party with a notice period of 1 week. The cancellation must be made by email or in writing.
The price of the products appearing on the website is indicated in euros. The total price consists of the sum of the selected offers. It is a digital offer. The delivery of access data is made electronically, without additional costs. The buyer is aware that by confirming his order, he is obligated to pay the final price as soon as the order is confirmed. The due amount can also be paid in full or in part using vouchers. The prices published on the website include 0% VAT (transaction without the application of VAT according to Art. 1, Paragraph 58, L. n. 190/2014, flat-rate regime).
The presentation of the offer does not constitute a legally binding offer but an unbinding online catalog. By clicking the "Order with obligation to pay" button, the user submits a binding order. The confirmation of receipt of the order takes place together with the acceptance of the order immediately after sending by an order confirmation display and additionally by a copy via automated email. With this order confirmation, the purchase contract has been concluded. The operator reserves the right to withdraw from the order in exceptional cases (e.g., unavailability). In this case, the user will be informed immediately.

By placing the order, the user enters his credit card details on the provider's website stripe.com. Access to the tool is granted after successful payment.
When selecting the payment method bank transfer, the operator provides the bank details on the confirmation page and in the confirmation email. The user receives direct access to the tool. If no payment is received within 14 days, the order is canceled, and all data related to the order is deleted.
It is a digital offer. There is no shipping via postal service. Access to the digital product is sent electronically (email or instant message).
Support for the user is provided via the contact form, email, and an internal ticket system. Customer service via telephone or in person is not offered.
The user has a period of 14 days in which he can withdraw from the purchase contract. The period begins on the day the buyer receives the access data. The withdrawal can be communicated via the contact form or the email address support@verleihtool.com.
The tool is the exclusive property of websystems and is protected by copyright. No part of the offer may be reproduced or distributed in any form without express permission. Theft of copyrighted content will be prosecuted. The user is liable for logos, trademarks, and photos used in the digital product. In this case, websystems is merely the executing hand and offers a digital tool for which the user himself is liable.
The policies described in detail on the website verleihtool.com regarding the processing of personal data according to European standards apply.
For all disputes, the jurisdiction of Bolzano (Italy) and the applicable law is Italian. Nevertheless, verleihtool.com reserves the right, if necessary, to apply legal measures from other jurisdictions to protect its interests and assert its rights.
If a provision of this contract is or becomes invalid, this shall not affect the validity of the remaining provisions.
